Welcome to Elyn Test API ("Service") provided by Wanot AI, Inc. ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.
Elyn Test API is a paid service that provides access to various AI APIs. The Service is currently in a testing phase and may be subject to changes or discontinuation without notice.
4.1. To access the Service, you must use an API key provided at purchase.
4.2. You are responsible for maintaining the confidentiality of your API key.
4.3. The Service is provided on a paid basis. Pricing details will be provided separately and may be subject to change.
4.4. In the event of service discontinuation, we will provide refunds for the remaining unused period of prepaid services.
5.1. You agree to use the Service only for lawful purposes and in accordance with these Terms.
5.2. While the Service is generally provided without limits, certain activities such as dataset generation may be subject to Rate Per Minute (RPM) or Tokens Per Minute (TPM) limitations at our discretion.
5.3. You are solely responsible for any content you input into or generate using the Service.
6.1. The content you create or generate using the Service belongs to you.
6.2. In cases where we log your input and output, you grant Wanot AI, Inc. a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute such content for the purposes of improving and operating the Service.
7.1. We collect and use certain data related to your use of the Service, including but not limited to the volume of requests and the number of tokens used.
7.2. By default, we do not log or use your inputs and outputs for any purpose beyond providing the Service.
7.3. In the future, if we decide to collect and use your inputs and outputs for purposes such as service improvement or research, we will explicitly request your consent before doing so.
7.4. You will have the option to opt in or out of such data collection at any time.
7.5. For information about how we collect and use your personal data for payment processing, please refer to the privacy policy of our payment processor, Stripe.
8.1. To the maximum extent permitted by law, Wanot AI, Inc. shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
a) Your use or inability to use the Service. b) Any unauthorized access to or use of our servers and/or any personal information stored therein. c) Any interruption or cessation of transmission to or from the Service. d) Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.
8.2. We are not responsible for any violations or illegal activities that may occur as a result of your use of the APIs provided through our Service.
You agree to defend, indemnify and hold harmless Wanot AI, Inc. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect.
